Todd represents plaintiffs and defendants in a variety of civil and criminal matters, with an emphasis on complex commercial disputes, intellectual property, and government enforcement actions. Todd also has substantial experience litigating matters involving California's anti-SLAPP statute, which provides procedural protection to persons sued for their First Amendment activities. Todd is a former Chair of the Trade Secret Subcommittee of the Intellectual Property Section of the California State Bar and has been a speaker on topics including electronic discovery, trade secret law, and the California anti-SLAPP statue.
Prior to joining the firm, Todd was an associate with the San Francisco office of Gibson, Dunn & Crutcher LLP, and a law clerk for the Honorable Vaughn R. Walker, United States District Court for the Northern District of California.
Representative Matters - Represented risk retention group in federal lawsuit brought against the Commissioner of Insurance for the State of California. Relying on federal preemption, obtained temporary restraining order and preliminary injunction barring Commissioner from enforcing Cease and Desist Order that had been issued against the risk retention group.
- Represented individual in matters relating to litigation brought against his employer based upon allegedly defamatory postings on an internet message board.
- Defended media broker in lawsuit brought by former client relating to the sale of a radio station. Case dismissed on demurrer. Successfully briefed and argued appeal before Third District Court of Appeals.
- Second chair in nine-week federal jury trial involving allegations of trademark infringement and breach of fiduciary duty.
- Represented national company asserting claims against former employee for copyright infringement and misappropriation of confidential information. Matter successfully settled out of court.
- Defended founders of consulting firm against claims of trade secret misappropriation and unfair competition brought by former employer. Matter successfully mediated out of court.
- Represented family in action brought against insurer and private investigator for invasion of privacy based upon improper in-home surveillance. Matter successfully settled out of court.
